Positions & Rights

Voting Right
  • Enacting, revising and abolishing ordinances
  • Reviewing and confirming budget plan
  • Approving settlement
  • Levying and collecting charges, fees, contributions, local taxes and membership fees except for duties

Right of Accepting Application
If applying a civil application to the council, it may be constituted by introduction of a member. The application should contain the name in full, address, signature and seal of an applicant and indicate clearly the intention and reason(s); if necessary, it may also attach references. The right of application to an administrative authority is a national right secured in the Constitution. However, when a resident is to apply a civil application to a local council, it needs the introduction from 1 member of the council. Therefore, a member of the local council may be a member of introducing an application if agreeing with the application.
Right of Opinion
The local council shall have the right to express its own opinions to the execution authorities, central government, other local government or other public or private organizations for the sake of the public interest of the local government. The right may supplement the right of resolution and supervision.
Right of Asking Document(materials)
The local council shall have the right to ask the governor of local government to submit documents relating to reviewing agenda, audit and investigation in order to audit the administration of the authorities and facilitate the review of agenda. The request should be executed at least 3 days before the date of submission.
Right of Attendance and Questions
The local council may ask the governor of related local government or authority or its officials to ask ques-tions in relation with administrative audit or review of agenda. Even during recess or closing of the session, the council keeps the system to ask questions in writing to ask questions and receive the responses.
Right of Speaking Agenda
A member of the local council shall have the right to propose an agenda, which is subject to reviewing and resolving in the council. However, the agenda pertinent to the rights of the chairperson, such as budget plan, settlement, agreement and approval may not be proposed by a member. The right is not the right exercised by individual members but by consent of other members. The quorum of general agenda such as proposal of ordinance needs one fifth or 10 and more members.
Right of Consent Speech
It is said that presiding a meeting starts with words and ends with words. A member shall have the right to ask questions with the permission of the chairperson(or the chairperson of committee), have a discussion and speak works of progress of proceedings or for oral consent.
Voting Right
The right is the most important and fundamental right of members of the local council and means that a member may vote for consent, opposition or abstention to an agenda to deliberate.
Suffrage and eligibility for election
A member of the local council shall hae the right to elect the chairperson, vice chairperson, the chairperson of standing committees and temporary chairperson. At the same time, a member is eligible for the positions.
